Welcome to Shop Everest Material Handling (“we”, “us”, “our”). We operate this online store to provide products and related services (“Services”). By accessing or purchasing through our website, you agree to be bound by these Terms of Service and our associated policies.

1. Eligibility and Account Responsibility
You must be at least 18 years old to make purchases. You are responsible for maintaining the confidentiality of your account and all activity that occurs under it. All information you provide must be accurate and complete.

2. Our Products
Product descriptions and specifications are provided in good faith. However, product images and colours may vary slightly due to device or manufacturing variations. Product availability may change without notice.

3. Pricing and Payment
All prices are listed in South African Rand (ZAR). Prices may include or exclude VAT depending on display settings. Delivery charges, taxes, and handling fees will be displayed at checkout. You agree to provide accurate billing details and authorize us to process payment using your selected payment method.

4. Order Acceptance
Your order constitutes an offer to purchase. Acceptance occurs only once we provide an order confirmation. If an order cannot be fulfilled, we will contact you and arrange a refund where applicable.

5. Delivery and Risk Transfer
Delivery timeframes are estimates. We are not responsible for courier delays or events outside our control.

Risk and ownership transfer only upon delivery to your specified delivery address, in accordance with Section 19 of the Consumer Protection Act (CPA).

Please inspect goods within 48 hours and report any damage or discrepancies.

6. Returns and Statutory Warranty
All products carry a six (6) month implied warranty under Section 56 of the CPA for defects in quality or workmanship.

Consumers purchasing online may also cancel an order within 7 days of receiving goods, provided items are unused and in original condition (ECTA Section 44). Return courier costs may apply for non-defective returns.

7. Intellectual Property
All content on this website is owned by Shop Everest Material Handling or its licensors. You may not copy, reproduce, or distribute any content without written permission.

8. Third-Party Services and Links
We may provide access to third-party tools and external links. We are not responsible for their content, accuracy, or service delivery.

9. Shopify Hosting Relationship
Our store is hosted by Shopify. While Shopify provides the platform, all sales, warranties, and obligations are solely between you and Shop Everest Material Handling.

10. Privacy
We process personal information in accordance with POPIA. For details, refer to our Privacy Policy.

11. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect or consequential loss unless arising from gross negligence.

12. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Disputes shall be resolved in the Gauteng Division of the High Court or other competent jurisdiction.
